AMPLUS PRIVACY POLICY

1. DATA PROTECTION

This Privacy Policy applies to AMPLUS Co., Ltd. (hereinafter “AMPLUS”) and our subsidiaries and affiliates. We appreciate you visiting our website and your interest in the products we offer. Protecting your personal data is very important to us. In this Privacy Policy, we explain how we collect your personal information, what we do with it, for what purposes and on what legal foundation we do so, and what rights you have on that basis.

 

This Privacy Policy applies to our website, online applications, kiosks, mobile applications, email, telephone inquiries, promotions, warranty registration, newsletter services, surveys, forums, sweepstakes/contest entries, our information practices and the choices you can make about the way we collect your information from websites hosted by service providers and merchant associates (collectively, the "Services").

Our Privacy Statement on the use of our websites and the AMPLUS Data Protection Policy do not apply to your activities on the websites of social networks or other providers that might be accessed using the links on our websites. By using the Site, Application, or Services, you agree to the terms of this Privacy Policy and the practices described in the Policy, in case of disagreement with the terms and conditions of our website (including AMPLUS Privacy Policy), we recommend that you do not access our website since the use of our website in these circumstances would mean that the relationship with AMPLUS would lack of the necessary legal framework that governs the relationship between both parties.

 

2. COLLECTING AND PROCESING YOUR PERSONAL DATA

We may collect (either by ourselves or through our trusted service providers or business partners) information that can be used to identify you or contact you ("Personal Information"). The information we collect may be of the following nature: (i) Personal Information by asking you to provide such information, (ii) Personal Information through automated, meaning that are part of the technology underlying our platform necessary to provide you with our services ("Website Navigational Information"), and (iii) non-personally identifiable information.

 

We also may use aggregate information, such as usage data, to improve the user experience on our sites. This data is collected only in the aggregate, but may include or be associated with other user information that you voluntarily submit.

When we ask you to provide personal information, it typically includes information that identifies, associates, or can reasonably be associated with you or your household. ✔ To protect against fraudulent, questionable, or otherwise illegal activities.

If we use third party service providers, these service providers are only required to use personal information for the same purposes for which we use personal information. Further, these service providers may only use personal information in accordance with our instructions.

 

We use the personal information collected during your visit to any of our websites to make using them as convenient as possible for you and to protect our IT systems against attacks and other unlawful activities. If you share additional information with us – for example, by filling out a registration form, contact form, chat, survey, contest entry or to execute a contract with you – we will use that information for the designated purposes, purposes of customer management and – if required – for purposes of processing and billing and business transactions within the required scope in each instance.

 

For other purposes (e.g. display of personalized content or advertising based on your usage behaviour), we use your personal data if and to the extent you give your consent through our consent management system. 4. TRANSFER OF PERSONAL INFORMATION TO THIRD PARTIES; SOCIAL PLUGINS; USE OF SERVICE PROVIDERS

We use third-party service providers, such as Internet Service Providers, to help us deliver our services and manage our technology platform. As part of these activities, we may use these third parties providers to collect information as described above. We are not responsible for the privacy practices of third parties or the content of linked websites. We include links or "widgets" to social media platforms such as Facebook, Google Plus, Pinterest, Instagram, and Twitter. These third parties features may collect information about your IP address and which pages of our site you are viewing, and they may set cookies for the purposes described in their privacy policies. These features are governed by the privacy policies of the companies that provide them, not this Privacy Policy.

 

When we use social plug-ins on our websites from social networks such as Facebook and Twitter, we integrate them as follows:

When you visit our websites, the social plug-ins are deactivated, i.e. no data is transmitted to the operators of these networks. If you want to use one of the networks, click on the respective social plug-in to establish a direct connection to the server of the respective network.

 

If you have a user account on the network and are logged in when you activate the social plug-in, the network can associate your visit to our websites with your user account. If you want to avoid this, please log out of the network before activating the social plug-in. When you activate a social plug-in, the network transfers the content that becomes available directly to your browser, which integrates it into our websites. In this situation, data transmissions can also take place that are initiated and controlled by the respective social network. Your connection to a social network, the data transfers taking place between the network and your system, and your interactions on that platform are governed solely by the privacy policies of that network. 

 

We also use qualified service providers (e.g., IT service providers, marketing agencies) to operate, optimize and secure our websites. We only pass on personal data to the latter insofar as this is necessary for the provision and use of the website and its functionalities, for the pursuit of legitimate interests, to comply with legal obligations.

6. TRACKING

In some cases, we may use tracking scripts or "tracers" that recognize unique identifiers from cookies placed on your hard drive by other websites. These are used to measure the success of our own advertising and to better understand your interest in other brands and companies with which AMPLUS partners. For example, we may use tracers to determine whether you have visited a particular web page on which AMPLUS has placed a banner ad. We do not use tracers to collect information about your Internet usage that is unrelated to AMPLUS. We also do not use tracers to identify your personal information, and you remain anonymous unless and until you communicate with AMPLUS.

7. USER GENERATED CONTENT

Any material that you upload or otherwise submit to our pages, such as data, questions, comments, ideas, suggestions, etc. ("Submissions") will be treated as non-confidential and non-proprietary information. Anything you submit or post becomes the property of our site, and our site is free to use and reproduce such Submissions freely and for any purpose. In particular, our site shall be free to use any ideas, artwork, inventions, developments, suggestions or concepts contained in any submission you make to our page for any purpose (including, but not limited to, developing, manufacturing, advertising and marketing products). Such use will be made without compensation to you. By making a submission, you also warrant that you own the material/content submitted and that our use will not infringe upon the rights of any third party or violate any applicable law. We are under no obligation to use any information submitted.

 

8. SHARING OF PERSONAL INFORMATION

Except as described in this Privacy Policy, we do not sell, rent, or knowingly disclose personal information (including its contents or your use of the Site) without your consent. In the past 12 months, we have shared, and may share in the future, your personal information without your consent for the purposes described below.

 

9. AFFILIATED BRANDS AND AFFILIATES

We may share your information with our affiliated brands, related entities or partners ("Affiliated Entities") for market research purposes and to send you advertising and promotional materials, discounts, newsletters, surveys, and product announcements. Except as described in this Privacy Policy, we do not transfer your information outside the AMPLUS organization.

A) We collect and analyze user information; conduct contests, sweepstakes, and other promotions; submit rebates; process credit cards in connection with orders; deliver packages; send postal mail and e-mail; remove repetitive information from customer lists; analyze data; provide marketing assistance; search results and links (including paid listings and links), and provide customer service. These third parties will use your personal information only for the purposes necessary to perform their functions.

B) As we develop our business, we may sell or purchase subsidiaries or business units, either directly or through legal proceedings such as bankruptcy. In such transactions, customer information is typically one of the business assets transferred, but we will continue to follow the obligations set forth in our existing privacy policy.

C) We may share customer personal information in the following situations (i) to comply with legal process or other legal requirements of government authorities; (ii) to protect and defend our rights or property; (iii) to enforce this Privacy Policy; (iv) to protect the interests of other users of this Site or others; or (v) to operate or maintain and repair this Site or to perform operation or maintenance and repair of equipment.

D) AMPLUS has several affiliated brands and companies that provide services globally. Similarly, we use several service providers located around the world. In order to provide you with services and access to our sites, we may transfer your personal information to jurisdictions outside of your country of residence, including processing personal information in the United States. Because this jurisdiction may not maintain the same level of privacy protection as your place of residence, your use of the Site and Services constitutes your consent to such transfer of your personal information. Even if we make such a transfer, the obligations of this Privacy Policy will continue to apply to your personal information, except where prohibited by local law. Third party service providers are also required to comply with the privacy and security obligations of this policy as described above.

We want you to have continued confidence in us and our products and services. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place reasonable and appropriate physical, electronic, and managerial procedures to safeguard the information we collect. Unfortunately, no data transmission over the Internet or wireless networks can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that (a) the Internet has security and privacy limitations over which we have no control; (b) we cannot guarantee the security, integrity, or privacy of any information and data exchanged between you and us through our Services; and (c) such information and data may not be viewed or altered by third parties during transmission. Except for personal information, we do not treat User Generated Content as confidential. You should not use the Services as a means of submitting information that would be considered confidential or proprietary. User Generated Content submissions will be treated as non-confidential and non-proprietary information and will be the sole property of the Company, which owns exclusive rights, including all intellectual property rights, and has the right to use this material for any and all purposes, commercial or otherwise, without acknowledgement or compensation to you.

 

13. LEGAL AGE

The Children's Online Privacy Protection Act (COPPA) protects the online privacy and personal information of children under the age of 13. We respect the privacy of children. The Services are not intended for children under the age of 13. We do not intentionally solicit or collect personally identifiable information online from children under the age of 13 without prior verifiable parental consent. Parents may also choose to opt out of the Subject. "Personal Information/Opt-Out" to access, change, or delete any personally identifiable information submitted by their children. We do not share or sell the personal information of minors under the age of 16.

The Service may contain links to non-AMPLUS websites. We are not responsible for the privacy practices or the content of any non-AMPLUS Web site. We have no control over the use of such web sites. User Choices Regarding Collection, Use, and Distribution of Personal Information

You may choose not to provide certain types of personal information to us. However, we do automatically collect website browsing information, so if you do not want to disclose such information, please do not browse our site. If you choose not to provide some of the information you voluntarily disclose (as described in the "Information You Voluntarily Provide" section above), your access to some of the Services may be limited (except where prohibited by law).

The information we collect, process and/or use about you is controlled by AMPLUS in Japan. The site is hosted outside the European Economic Area.
